This Privacy Policy explains how ZARIYAA HAPPY WELLBEING PRIVATE LIMITED, hereafter Zariyaa, collects, processes, uses, shares, and protects information about you. It also tells you how you can access and update your information and make certain choices about how your information is used.

This legal agreement is an electronic record in terms of Indian Information Technology Act, 2000 and rules there under as applicable and the amended provisions about electronic records in various statutes as amended by the Indian Information Technology Act, 2000.

Zariyaa is an online platform that facilitates the offering or provision of comprehensive primary and mental healthcare services by authorised healthcare professionals to service recipients primarily through its website and through its website/app.

  1. APPLICABILITY

    This Privacy Policy applies exclusively to this website/app with immediate effect and by visiting our website/app you agree to be bound by this Privacy Policy. This Privacy Policy is binding upon you on each circumstance when you visit the website/app including while registering yourself on website/app, undertaking any transaction on the website/ app with third party, transacting with Zariyaa etc.


  2. INFORMATION WE COLLECT


    We collect information to facilitate better services to all our users and the following are an indicative list of information we may collect from you:

    • Personal information such as your full name, date of birth, gender and other such information by which we may identify you.

    • Sensitive personal information that the law deems necessary for our authorised healthcare professionals to provide you with care and services through our website or app, such as your username and password, financial information (such as bank account, credit card, debit card, or other payment information), physical, physiological, and mental health condition, sexual orientation, medical records and history, and any other information.

    • Contact information that you voluntarily give us, such as your name, address, phone number, and email address, as well as equivalent information about your spouse, legal guardian, family members, or other individuals.

    • Information without which our authorised healthcare professionals may not be able to provide you with adequate or appropriate care and services.

    • Usage Information may be collected using a cookie. If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. Cookies can be disabled or controlled by setting a preference within your web browser or on your Device. If you choose to disable cookies or flash cookies on your Device, some features of the Services may not function properly or may not be able to customize the delivery of information to you. The Zariyaa cannot control the use of cookies (or the resulting information) by third parties and use of third party cookies are not covered by our Privacy Policy.

    • Correspondence data, such as any emails or letters you may send us as well as any correspondence regarding you that third parties may send to us.

    • Any other information that you voluntarily choose to provide us.

  3. USE OF THE COLLECTED INFORMATION


    • Our primary goal in collecting your information is to provide you with an enhanced experience while using the Services.

    • Your mental and physical health related data is shared with the consultant with your consent so that the consultant can effectively cater to your needs.

    • We use your email id and mobile number to send you reminders about upcoming sessions and other information related to your account.

    • We use your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer our website/app. Although it does not include any personal information about you, your IP address is only used to identify you.

    • We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our Services are temporarily suspended for maintenance, we might send you an email.

    • We might use and share your information to get in touch with you about appointments, follow-up, to advise you of any unfinished transactions, to get your opinion on the services you've received through our website/app, and for other purposes.

These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing the Terms of service, this Privacy Policy, or for complying with the applicable laws and regulations.

This includes requests by telephone, all interactions with the consultants, any scheduling or appointment notes, all session content records and any progress notes that consultants take during their sessions. However, the law place certain limits on the confidential nature of consultant’s services. Typically, these limits on confidentiality may arise if consultants perceive there is a risk of harm in situations that include the following: Imminent danger to self or others if a person presents an imminent danger

    to themselves or others, the law requires that steps be taken to prevent such harm, which can include releasing information about a person’s emotional state.

  7. SECURITY


    • The Protected Information and Usage Information we collect is securely stored within our databases, and we use standard, industry-wide, commercially reasonable security practices such as encryption for protecting your information. However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee that such information will never be accessed, used or disclosed in a manner that violates this policy. User is solely responsible for maintaining the confidentiality of user password and user identity.

    • Zariyaa will not be responsible for any disclosure of User’s data or records by any of the consultant, although Zariyaa will take appropriate actions against the consultant.

    • The User shall be solely responsible for all activities and transmission performed by the User through his User identification. Zariyaa assumes no responsibility or liability for their improper use of information relating to such usage of credit cards and/or debit cards by the User, whether online or off-line.

    • If you are located outside India and choose to provide information to us from there, Zariyaa will transfer and keep your information safe. Your submission of information represents your consent to this transfer.


  8. YOUR RIGHTS


    Unless subject to an exemption, you have the following rights concerning your data:


    • The right to request a copy of your data which we hold about you;

    • The right to request for any correction to any personal data if it is found to be inaccurate or out of date;

    • The right to withdraw your consent to the processing at any time;

    • The right to object to the processing of personal data;

    • The right to complain about a supervisory authority.

    • The user have right to know whether personal data is transferred to a third country or an international organization. If you have an account with any of our services, you are entitled to a copy of any personal information we hold about you.   9. GOVERNING LAW AND JURISDICTION

    Zariyaa agrees that any suit, action or proceeding against the Company brought by any, directors, Experts, officers, users, and any affiliates, or by any person who controls company, arising out of or based upon this Agreement, and any claim, controversy or dispute arising under or related thereto or the transactions contemplated hereby may be instituted in Karnataka, India, and waives any objection which it may now or hereafter have to the laying of venue of any such proceeding, and irrevocably submits to the exclusive jurisdiction of such courts in any suit, action or proceeding.


  10. MISCELLANEOUS

In case of a conflict in any terms of Privacy Policy, the decision of Zariyaa shall be final and concluding, and you irrevocably withdraw your right to make any claim on this ground. Please also read Terms of service as set out on the website/app. By accessing the website/app, it shall be deemed that you have read the Terms of service and this policy and the same are acceptable and binding upon you.
